As a general rule unless there is specific regulation prohibiting or limiting fees on surplus lines there is "freedom of rate and form" and this would include the charging of fees. The only states that regulate the charging of fees on surplus lines are FL, NJ and MI.

Take a more professional route. Contact their insurance carriers and ask if they find this business practice acceptable. Let them put pressure on the other agency to discontinue this business practice.

You are trying to find someone who has a minimum premium below $250? I can't see where it would cost effective to do that for a carrier. Good luck. Not sure I would spend too much time since your max commision will be around $25.
