Electronic Cigarette Product Liability

Post by MarchInsGp »

I am looking for a company that not only provides liability, but also product liability. The current companies we are working with either do not provide product liability, or they are pulling out of the E-Cig market altogether. We have retail stores, wholesalers, and manufacturers we need placement for. Any help would be appreciated.

Thank you,

Daniel March

I know this was an older post but subject is still very much relevant. If your agency currently has E-Cig clients, review their policy carefully and pay attention to how policy exclusions read (i.e. tobacco exclusion, health hazard exclusion, absolute pollution exclusion etc). Beyond that, large number of vape and e-cig products are sold online so there is cyber liability exposure. Then coverage for products while in transit or being stored. Don't forget about product recall coverage too.

Carriers may title endorsements on their policies as "Electronic Cigarette Endorsement" or "E-liquid Endorsement". Don't allow the titles of these endorsements to give you a false sense of security. In most cases they will exclude the chemicals which make up the flavoring. You should also examine the FDA 21 CFR (172.510) and FDA 21 CFR (172.515) to see how your clients products may be affected by the aforementioned.
