We are looking at bringing on a strictly sales P&C producer. All servicing & csr work would be handled by the agency. According to my research, in the past it was very common for Sales to be an IC position however that seems to be changing given some recent court activity and the general guidelines that need to be met for a person to truly by an IC. My question is, does anyone have (or are you one?) P&C producers that are independent contractors and what are some of the guidelines you use to make that work?
You'd want to check with an attorney well versed in IRS and EEOC guidelines. Most likely this would fail both EEOC and IRS tests for true independent contractor status.
