Attacked in a Restaurant: The Insurance Implications of Assault and Battery

    what about the attacking party is from the customer,………i had a case, a customer tried to get his $100 bill changed to smaller bills, came to the restaurant, due to bill was over $20, per store policy, no change was allowed, further more, this customer did not want to buy a thing. after bill changed was refused by a store employee, this customer got angry, tried to grab that employee through a small window on the protection glass wall, did not able to touch that employee, instead, accidentally cut his own right fore-arm, got bleeding, left, later on, through a lawyer, suing the restaurant, restaurant insurance carrier refused to come out and defend the restaurant and restaurant needs to hire another lawyer to defend them………..can restaurant carrier not to provide defense at all??
