NYID Appeal Reinstates Start of Reg 68 Reforms

For the moment the implementation of the changes in insurance regulations contained in regulation 68 issued by the New York Insurance Department have taken effect.

Last Friday The State Supreme Court in Manhattan blocked the new rules from taking effect on September 1st (See IJ Website Sept. 3). The NYID appealed that order through the attorney general’s office. That action automatically stayed the order, and allowed the the new regulations to take effect as scheduled, pending the resolution of the case brought by trial lawyers to block them.

The reforms, declared vital by the insurance industry in order to limit widespread fraud in personal injury auto cases, would reduce the time limits for giving notice of an accident to 30 days, and the time for reporting injuries to 45 days.

A hearing on the merits of the case is now scheduled to be held on September 27th, which will give both sides more time to present evidence in support of their respective positions.
