Doctors who make mistakes that impact people’s lives should be made to pay. A baby born with CP due to a doctor’s negligence should receive enough money to take care of that baby through childhood, and adulthood. How much will that be? Who knows? That is the reason for the high awards. People who are tragically harmed by physicians should not be limited as to the amount they can receive for damages.

I read with interest S. Lobel’s comment on CP babies. The new rearch literature shows that CP is not due to doctors or midwives negliance. The courts and the malpractice settlement representatives are way behind in the new research in OB. It it time that we change the system and establish expert panels to decide what is negliance and what is not!

Economic damages for the care of an infant would still be unlimited. Most of the caps being discussed are for limiting “pain and suffering” damages which are notoriously difficult to calculate.
