Doctors who make mistakes that impact people’s lives should be made to pay. A baby born with CP due to a doctor’s negligence should receive enough money to take care of that baby through childhood, and adulthood. How much will that be? Who knows? The courts and the malpractice settlement representatives are way behind in the new research in OB. It it time that we change the system and establish expert panels to decide what is negliance and what is not!
Economic damages for the care of an infant would still be unlimited. Most of the caps being discussed are for limiting “pain and suffering” damages which are notoriously difficult to calculate.
