Is this guy nuts, a liberal Democrat or worse yet a Trial Lawyer(extornist)? The fund that he proposes is nothing but a slush fund for Trial Lawyers as that is where the funds will end up. Knowing that this fund exists will result in more suits that get settled out of court so as to protect the reputation of the Doc and to avoid the uncertainty of the results of a trial by jury. Extortion is a better word to describe many of these suits so now this guy wants to make more money available to the extornists!
Why not call a special session to cap awards and to eliminate punitive awards or better yet, fund his idea with 75% of any punitive award! NOw that is how you can cut med mal rates and lower the cost of our health plans too!
