Commissioner Mirel’s comments are surprisingly misinformed. Spitzer is not attacking a company and then sitting back to wait for a settlement. He’s investigating, digging beneath the surface to find illegal conduct. Too bad the Commish wasn’t doing the same. Yes,everyone knew about contingent commissions, but no one knew about steering and bid rigging until Spitzer got involved. To date, there have been five guilty pleas at three major companies. That’s not sitting back. As for Bruce’s comment about the investigation hurting insurance companies. The process of rooting out corruption is indeed painful. And it’s terrible when workers are impacted. But it has to be done. You can’t ignore it. Fortunately, in the long run, the companies emerge stronger. See investment banks and mutual funds, both of which have rebounded well since resolving problems.
