Someone slips on their own front porch and the sue the newspaper? How did this ever get to court?

New Jersey – and a lot of other states – have to start closing the gate on these stupid lawsuits.

This guy and his lawyer should have been laughed out of the courthouse by someone with some sense. Incredible that this should have been allowed to proceed.

As an insurance claims adjuster I see these kind of claims all the time. The reason these kind of claims get to court is because the courts, in my opinion are too leinent. I have seen lawsuits where the plaintiff while talking on a cell phone rear ends another vehicle that was stopped. This person files a lawsuit and an abitrator finds the stopped vehicle 50% at fault and awards the plaintiff 100 thousand dollars. Also the judge that heard the liability summary judgement motion allowed the case to continue.

This type of friviolus litigation will not stop no matter what laws are passed until the court system impliments common sense in their decisions.
