Federal Highway Bill Bans Vicarious Liability of Car Leasing Firms

    How many states does this bill effect? 16 I heard. Is Florida one of them?

    Living out west in Colorado, where we tend to take more self responsibility, I was amazed to learn that such a law even existed.

    I found it extremely difficult to believe the voters of New York would have allowed that situation to remain. It had to be a major damper on businesses and individuals, not to be able to lease a car as opposed to purchasing one.

    So far it’s not changing the behaviour of any of the leasing firms. BMW Financial Services stated to me today they have no intention of lowering their acquisition fees. Moreover, they informed me the amount of the fee they actually impose on the dealer is less than what the dealer passes on to the consumer, since there is a profit structure built-in. This is a misrepresentation by every dealer I have dealt with, all of whom claim the fee is set by the leasing institution.

    Are car leasing companies the only ones affected by this ban? Are the lessors of commercial semi-trailers also relieved of vicarious liability for the tractor(if separetly owned and operated) and the driver who is either an employee of the company leasing the semi-trailer,or and individual owner-operator under contract to the company leasing the semi-trailer?

    What is the effective date of the legislation? Does it apply to accidents occurring before the date the bill was signed into law? What about lawsuits brought after the signing date involving accidents occurring before the signing date?

    The law still covers the minimum state imposed liability insurace. For Rhode Island it is 25000/50,000/25000. The car rental companies such as Avis, Budget and Enterprise hide the fact that the cars they rent have minimum state required liability insurance allready covered in the rental price. They still try to sell the ALI (enterprise does this forcefully ) to rip off the lessies.

    So should we continue to take Additional liability insuarance (ALI) offered by such car rentals since most of the usual car owners also only purchase the state minimum liability coverage.

    Shouldn\’t the Vicarious liability insurance law be different for the leasing companies and the short auto rental companies such as Avis, budget and enterprise.

    Thank you for printing my question, but do you have the answer; or where can I get an answer. Everyone seems to be so sure that the reference to car leasing means that the law bans vicarious liability on any type of vehicle leasing, but I have not found anything written to confirm this.
    Please advise. Thank you. Pat
