Of course it is Wendy\’s fault she got sick. If it were any other reason, she wouldn\’t be able to make a ton of money off this.

I love the way the lawyer says the the employee didn\’t wash his hands, but then says the cause was the burger not being cooked all the way. Wendy\’s uses pre-made patties, so even if the employee touched the meat, it would have only been on the outside, which comes in contact with the grill….which is well hot enough to kill E. Coli.

If an uncooked burger was the problem, the E. Coli would have to be inside the patty. Not impossible, but the employee\’s habits had nothing to do with the issue, aside from muddying the water.

/Has never had an undercooked hamburger at Wendy\’s.

Here we go again. Another person who believes in the lawsuit lottery. What a bunch of crap. How convenient for the husband to \”remember\” seeing an employee not use soap. How come he did not have a problem going back and eating his burger then? If I had seen that, I would have told the manager and not ordered any food that is for sure. I hope the jury isn\’t swayed by this con job.

Now if you had told me it was an OVER cooked burger at Wendy\’s I would believe it, but never have I seen or heard of there being blood anywhere near a Wendy\’s hamburger patty. It just does not happen.
Does anyone else see the effect that these lawyers have had on our society?

I suppose that this well intentioned consumer has health insurance that would take care of her medical bills, but then how am I fooling?

It appears the attorney is only along for the ride. I sure hope Claims Guides prints the outcome when these people lose the case AND are ordered to pay restitution. Maybe the employee only rinsed their fingers??? Go Wendy\’s!! I still eat there.

I noticed the husband didn\’t wash his hands the recommended amount of time. I happened to also be in Wendy\’s that fateful day. The customer did not slowly sing the ABC\’s while washing his hands and wrists. He finished by drying his hands on his pants.

I suspect he gave his wife the E. Coli virus when she washed his pants…..hmm…..

I worked at Wendys for 6 and a half years. Never in my time their was a burger given out bloody. If they did there would have been a lot more than just one person sick. Usually 5 to 6 patties are put down at one time, and all turned and cooked the same. If it was a busy time it would have been more than that. If she had gotten sick from the patty at least 4 other people would have also gotten sick. Unless they were so slow that she was the only one to order a burger within about 3 mins. I suppose it could happen but I really doubt it.

Think about it, you see the kid in the restroom, then you walk out and order. You get your burger 2 minutes later. If that kid has dirty hands, it wont affect the burgers that are cooked for at least another 5 to 10 minutes. Remember, its fast food.

Here we go again! Who can I sue? I want a piece of the American pie too! How the devil did the husband know that that particular employee, that did not wash his hands, cooked his burger? Was he the only one grilling the burgers? Also, I would investigate if any of the lawyers were ever connected to the testifying physicians in the past in previous cases.
