Rx – I agree that the skyrocketing malpractice insurance is in dire need of help by addressing some of the serious underlying causes. However, I wonder if your response to this would be the same if it was you and your prostate or your wife/mother/sister? From someone who was also grossly misdiagnosed. Did I sue? What do you think?
The doc does two tests and neither shows cancer, but it is his fault for trusting the tests and not requesting a biopsy? Jeez, if she was that concerned, she could have gotten a second opinion.
This decision is another reason why we should make all civil trials trial by judge(s). It is impossible to get a jury of your peers because only people too dumb to get out of jury duty end up serving.
