In Maine, Wrongful Death Suit Blames Forklift Design

    This type of forklift (non-counterbalanced) has no intrusion protection, when it should have. Other types of forklifts (counterbalanced) have intrusion protection i.e. overhead guards and four supporting pillars. I support the plaintiff. The defense lawyer is clutching at straws. With sufficent intrusion protection this incident could have been avoided.

    I agree with Ray.

    It\’s sad for Mr. Brown, however it\’s not only possible but PROBABLE that his mind was distracted at the time of the accident.

    What additional feature does the plaintiff believe would have made it a safer vehicle to operate?

    The reason it applies the emergency brake is if both feet come off the pedals, the person may have fallen off – prevents being run over by the lift.

    Maybe the thought of his 30th anniversary to the same nag is why he intentionally back into those shelves?

    My husband has been a forklift mechanic for 15 years and he is always witnessing careless operators of forklifts. He is surprised at how many companies do not train there employees how to safely operate a forklift. Prime should have trained every employee they have and made sure they new every issue of saftey that might come up. It is not the retailers responsibility to train operators but those who will use thier product.
