IF the deceased\’s employer was notified by the forklift\’s manufacturer of the defect but failed for whatever reason to remedy the defect, isn\’t the employer liable for the employee\’s death rather than the manufacturer? None of the reports has reported whether or not the employer was aware of the defect, so I wonder if that came out during the trial. Or is it that the manufacturer\’s pockets are deeper?
In PA there is no apportionment against an employer for their negligence for contributing or causing injury to an employee if Work Comp is available. There are too many unknown facts to determine what the employer actually knew, and whether the information was passed along to the decedent.
I think it stinks that the wife was told she would get X amount of money but because of where she lives she’s getting 1/4 of it. That isn’t paying all the bills people!
