Conn. Court: AG Must Release Internal MassMutual Report on CEO

Attorney General Richard Blumenthal said today that the Connecticut Supreme Court has dismissed Mass Mutual’s appeal to stop him from publicly releasing the company’s internal investigative report on its former chief executive officer.

Mass Mutual has until April 13 to ask the court to reconsider its decision, or take other action, before the report is released, according to Blumenthal.

The Hartford Courant had requested a copy of an internal investigative report that Mass Mutual turned over to the attorney general’s office as part of Blumenthal’s ongoing investigation into the insurance industry. The report involves the company’s former CEO, Robert O’Connell, who was fired in June 2005 for what the company claimed was a pattern of abuse of authority. Those charges were denied by O’Connell and in October last year an arbitration panel found that he had been wrongfully terminated.

Mass Mutual has been fighting in court to prevent the internal report from being released publicly. Blumenthal had argued – and a Superior Court judge agreed – that state law required him to turn over the document upon a freedom of information request. Mass Mutual appealed the trial court decision.

In today’s decision, the Supreme Court dismissed Mass Mutual’s appeal.

“Today’s ruling confirms that Mass Mutual cannot appeal the trial court’s decision,” Blumenthal said. “I hope that Mass Mutual will accept legal reality and avoid further appeal or delay. We will continue to fight to uphold freedom of information principles that require public disclosure of this document.”
