    If this guy is so traumatized why didn\’t he move out of the city? Or, at the very least, move out of that building… One would think mental anguish would cause him to have horrible flashbacks every time he enters that apartment building.

    Now, if he didn\’t have renter\’s or homeowner\’s insurance that is too bad for him. He shouldn\’t sue someone else because of his own stupidity (if that is the case).

    Good point MD… he is acting like more of a baby than most babies. And kids have gotten through worse and come out stronger (ie: crimes and NOT tragic accidents). What a crock!

    I couldn\’t agree more! This man and I use that term as loosely as possible should be ashamed of himself! It is not bad enough that Lidle and Stanger families had to deal with the tragedy they were subjected to the day of the crash but now they have to continuously relive it with these MORONS claiming post traumatic stress? Get a life! Move out of the building and carry out the rest of your days being thankful that you survived. And leave the poor families alone to grieve and move on with their lives.

    This guy is a big wuss! If he is so traumatized, why doesn\’t he move to a tree house in Montana where these things never happen? :-) I am doubly sure there are a lot more people out there with stronger constitutions than this guy…like all the rest of us.

    Mr. Sparta, you sicken me. My Dad received 5 purple hearts while serving in the military in Europe during WW II and in Korea. He suffered Post Traumatic Stress Syndrome to the day he died and was buried at Arlington National Cemetery with full honors. Despite his injuries he raised a family and was smart enough to insure his property, his life, and his family.

    Our troops in the Middle East and elsewhere suffer Post Traumatic Stress Syndrome- they deserve our thanks and our support. If you can afford to live in that building then you certainly could afford to insure your belongings.

    As for suits against the airplane manufacturer, this is more typical liberal crap. There is no evidence that the airplane was at fault but it is SOP to sue the manufacturer when a plane goes down.

    I was a big Cory Lidle fan and I am very sorry for his wife and other survivng family members. Perhaps if I lost a loved one in a plane crash I might feel inclined to sue, but I doubt it.

    Have we all forgotten that sometimes **** happens?

The plaintiff bar and the general public needs to hear something other than the garbage the plaintiff bar feeds them in the media. The bozo who took this case should be ashamed.

    First, let me say that the whole \”mental anguish\” thing sounds a bit far-fetched as if it were dreamed up by this guy\’s \”no fee unless we win\” plaintiff\’s attorney.

    Having said that, I do believe that there might have been a case here if the plane had damaged his apartment. Look at it another way: If this guy was in his home in the midwest somewhere and a driver accidentally plowed through his livingroom window, you wouldn\’t think twice that he sued for compensation from the driver\’s insurance company.

    \”The probable cause of a small airplane crash in Manhattan last October was the pilots\’ inadequate planning, judgment, and airmanship in the performance of a 180-degree turn maneuver inside of a limited turning space.\”

    \”The NTSB found no problems with the plane itself, and suggested that the plane could have made the turn, if they had aggressively banked the plane during the turn or made an illegal turn over buildings.\”

Puhleezzzee – The guy moves to another part of the building and whines for someone to pad his pockets… What a crock – People like this make me sick – He should learn from the experience and be thankful he was blessed to live another day – and embrace it – not profit from it…

    For what it\’s worth, the attorney, David C. Cook, was admitted to the NY Bar Assn in 1973 and enjoys a Park Avenue address…he went to Brooklyn Law School…remember, they\’re just looking for a settlement from one of the defendants, and since the slacker plaintiff, Sparta, was at home when the crash occurred during the afternoon, what do you think the chances are that his live-in girlfriend is the one with stable employment? Let\’s all say a prayer for Melanie Lidle.

    The other day I watched the evening news and they showed a car accident and now I have horrible flashbacks every time I walk past the TV.

    Please don\’t make light of the story at hand, no matter how funny your response was… (I am still giggling…)
    The issue is, this guy and others like him are using a very sad situation and trying to profit from it. I have an 18 year old step son that suffers post traumatic stress disorder due to a family member that abused him with his bio mom knowing and allowing it. His dad and I have spent years with him in therapy trying to reverse the damage that was done… bottom line, he will live with this the rest of his life, but he is graduating high school this June with a high honors. This Sparta character needs to get a grip, seek some therapy and move on. Mrs. Lidle my thoughts are with you even though I am a Red Sox fan and a bigtime Yankee hater!

    Okay, so let the man recover the loss from someone else\’s insurance company so his rates don\’t go up (if he even has coverage). I can live with that… but suing the family? What about the pilot who was also on board? Why isn\’t his family being sued? Probably because they don\’t have as much money. Just a thought…

    And mental anguish? Yeah right. I\’d like for him to prove he was even at home at the time of the crash. Was that verified at the time? Really think about this though… If he was SO upset by this accident WHY IS HE IN THE SAME BUILDING??? When people are attacked in their homes and move, they generally don\’t move to another floor or down the street.

    He seems to just be trying to extract money from this poor widow so he can get rich(er). Mental anguish? Give me a break!

    I\’m sorry LD. It\’s just one of those situations where if you don\’t laugh, you\’ll cry.

    My dad has been dealing with post-traumatic stress since the OKC bombing (he\’s on the Bomb Squad) and having to go into that building and step over the bodies of children while looking for other possible devices (they didn\’t know the bomb had been in the Ryder truck at that time) really screwed him up for a while.

    But like El Squid\’s dad and like your young \’un, my dad was able to overcome because he found strength within, and not dollars from deep pockets.

    PTSS/PTSD are serious problems and I\’m not making light of that. But Spart is a serious moron and completely deserving of every cheap shot we can toss his way.

    Where has this sense of \”entitlement\” come from anyway??? If I acted like I was entitled to money because I was present for a tragic event, I should hope I have a friend or relative who is willing to thunk me on the head and say \”Get over yourself!\”

    Sparta, sounds more like an attorney than an architect. Our soceity has become sue crazy. Sparta most likely had insurance of his own which covered his losses, he\’s just trying to padden his wallet at someone else\’s expense….sad,sad, sad!
    Regardless of any argument presented in court, if I were a juror in this case, my mind would be made up right after opening statement.

    I reiterate, this\’ll never go before a jury; they\’re looking for a settlement…so, how much is it worth to make him go away? $50K? $250k? $500k? A jury wouldn\’t give him a dime and by the time the calendar draws near, his lawyer will have given him a reality check…maybe everyone will decide to push it to trial and let him walk away with nothing…seriously, this is going to get a lot of very negative press, it\’ll be hard to seat a sympathetic jury.

    Squid, I hear you, but in this case, I\’m reading commentary posted on general news sites and so far, almost without exception, the little people are reacting with hostility and contempt. FWIW, a few have commented about a suit filed by Mrs. Lidle, but I suspect that may have been necessary because the NTSB report didn\’t identify who was actually at the controls at the time of impact.

    I thought the same thing Jewel, everyone in agreement on this one.

    The only people I can see suing the estate would be the insurance company subrogating for any payments for the damage to the unit (if he had coverage and if they paid out).

    Compensation for the slacker who wasn\’t at work when the plane hit…no, instead, let\’s give him a year in art school. As an architect, he has the structural background needed for welding as an art form and it would be fun to see him express his angst in metal…actually, come to think of it, he\’d find a ready market at gov\’t buildings under the arts endowment so we could ALL support his therapy…

    It\’s my opinion that Sparta, despite what you think about his alleged injuries, has a better case of negligence against the pilot of the plane than the Lidle family has against the plane manufacturer. I think the family\’s lawsuit is even more bogus than Sparta\’s. It appears that the investigation is leaning to pilot error rather than a malfunction in the plane, and yet the family is still trying to profit from their suit against the maker of the plane. Where is the outcry about this sort of exploitation? I understand grief and loss better than most, but I don\’t understand suing a business in the circumstances of this case when it seems clear from the investigation that this tragedy was caused by one or both of the victims. Will the family\’s lawsuit against the plane mfg increase the victims\’ lives by even a moment? I think the frivolity in this situation rests with those family members trying to profit from the deep pockets and anonymity of the manufacturer of the plane when the investigation into the cause of the crash has not been completed and appears to be leading to the conclusion that the victims themselves were the cause of their deaths.

    I see no problem with the estate paying for the claimant\’s contents coverage and some additional living expenses. There is a clear cut example of negligence, and no one would object to a property insurance carrier subrogating against the estate.

    As for every other claim made be the estate and the claimant, throw \’em out.
