    Where were the parents? I can’t imagine my 4 year old granddaughter being left to here own devices around a pool area. Most pools of this type have no lifeguard. This is a terrible loss, but I wonder again about personal reponsibility.

    I agree. I NEVER rest when my Grands are near water, the same when my children were young, TWO eyes on the kids, always. Can’t see them, I’m off my butt searching.

    No one is responsible for anything these litigious days. Not THESE parents. Everyone is a victim and has an excuse,
    the Jenna 6 (It was racism), Michael Vick (i’m a southern boy, that’s what we do), not Mel Gibson (i really don’t hate jews, i was just drunk).
    Makes me want to vomit, most days.

    The parents were probably inside at the bar slamming martini’s with their snooty country club friends. Agree w/all that nobody should leave a 5 year old alone near water EVER. They should have had the child wear inflatable water wings or a lifejacket. You can bet their attitude was that they paid to belong to the club so they were entitled to use the pool as a babysitter. This doesn’t say if the drowing occured in the adult pool, or a wading pool. If it was the latter, most places don’t have lifeguards. Even so, $4MM is a lot of money for a 5 year old under any circumstances. You know the parents are in it for the money when they’re appealing the $1.3MM cap on wrongful death.

    The rule at my pool is that you must keep your children that can’t swim at arms length. I assume this poor child was a non swimmer. This article does not state all the facts, but I agree the parents are primarily responsible for the safety of their children. We are now a nation of “I am hurt, and somebody is going to pay.”

    Sad…just sad.

    First of all yes it was the parent’s responsibility and unfortunately even one second of taking your eyes off a child can end in tragedy. NO amount of money will bring this child back either way.

    What do you mean the Jenna 6 incident is an excuse? None of these parents have sued. Their just trying to keep their kids out of jail. Hopefully they will sue later. The Jews came out on Mel so why can’t Blacks come out on what is blatantly racism?

    Made a stupid mistake but breaking a man down to the lowest common denominator for dogs? How about the guy who gave cats to his pit bulls for them to eat (check out Channel 2 news website – Atlanta). In fact it was crazy Whoopi Goldberg that made the southern remark and in that case dog-fighting in something people of every race do here in the south, believe me. They just haven’t been caught yet.

    Before you make crazy remarks about something totally unrelated to the story at hand and offend people – think twice before you type.

    Anne Arundel County (Map, News) – Surrounded by photographs of their dead son, the parents of Connor Freed, the 5-year-old Davidsonville boy who drowned in a Crofton pool last month, announced Thursday a $20 million wrongful death lawsuit against Crofton Country Club and its pool management company.

    “He was the sweetest child,” said Connor’s father, Thomas Freed. An attorney for Freed and Debra Neagle Webber, Connor’s mother, filed the lawsuit Thursday in Anne Arundel County Circuit Court.

    It alleges that Crofton Country Club failed to provide an adequate number of properly-trained lifeguards to monitor the pool where Connor drowned.

    Wayne Rohauer, the manager of Crofton County Club, said he could not comment on pending litigation.

    On June 22 Connor was at the country club with family friend Paul Carroll, who was watching Connor and two of his own children at the pool, said the family’s lawyer, H. Briggs Bedigian. At about 4:30 p.m., Carroll took off Connor’s lifejacket so he could go to the bathroom, Bedigian said.

    According to Bedigian, Carroll was watching his younger daughter in the pool and, after he hadn’t seen Connor in a few minutes, sent his son to look for him in the bathroom.

    When his son left, his daughter cried out that Connor was floating in the pool, Bedigian said.

    Bedigian said women at the club helped Carroll drag Connor out of the pool, and that the lifeguards attempted to perform CPR. An ambulance transported Connor to a hospital, where he died about an hour after drowning.

    Bedigian said the family doesn’t hold Carroll responsible. “When we go to a pool with trained lifeguards we are under a reasonable belief that lifeguards will perform their duties,” he said.

    Thomas Freed said he is filing this lawsuit to attack complacency in lifeguards throughout the state.

    “If one family is spared from the pain and anger and all the rest of what we are going though, his life will not be lived in vain,” he said.

    My heart goes out to these parents for the loss of their child. I can’t imagine their pain. That said…I do agree that keeping track of a small child around a pool is the parents responsibility. I have a 3 yr old and I wouldn’t care of the pool is full of lifeguards who are all watching my child. Daddy is going to be there right next to my little girl. I wish I knew the answer to getting our society to take responsibility for our own actions or lack there of.

    Wow, I’d hate to be the guy who was supposed to be watching the kid and took his life vest off. I’d have never taken that kids lifevest off. I’d never have let him go to the bathroom alone either. Again, as an over protective parent of my own 3 yr old, I’d never have let my little one go to the pool with someone else to watch them.

    Shield – you’re right on point. You don’t unilaterally delegate responsibility to prevent your child from drowning to a lifeguard. They can’t possibly be the guardian angel of every person in a pool.

    African Pride – will all due respect, you’re on thin ice. While the whites in the Jena 6 matter were incredibly stupid and insensitive, they didn’t break any laws, damage any property, or cause personal injury. I’m not excusing their behavior, but the Jena 6 had no right to take things into their own hands, break the law, and cause personal injury. Nobody is entitled to do that. Stop the racist rant.

    Once again the responsible party, the parents, pass the buck and sue. And people wonder why insurance rates are so high.

    I think we all agree it was the parents’ responsibility, not the friend or the lifeguards. We all also agree that the family is devestated. That being said, no amount of money will bring the boy back, and who needs more than 1.3M anyway? They are turning a tragedy into greed which takes the focus off of the boy’s death and puts it on the parents’ desire to milk the country club for all they can. Take the 1.3M and let it go, focus on your child which is what you should have done in the first place.

    What is sad is that you see so many in our litigous society exploit a loss and then to cover for their greed they say they are doing it so that their child’s death wasn’t in vain etc…blah, blah, blah. I’d have more respect for them if they were just honest and said, it sucks that I lost my kid but I’m not going to lose this chance to get rich.

    For everyone’s little racist comments, I was addressing one person.

    (1) There is property damage as there was a fire at the high school and it remains to be seen who the culprits are.

    (2) If my remarks are B.S. then B.S. recognizes B.S.

    (3) I dont’ condone violence of any kind but only the Black ones have gone to jail and the white male who was assaulted was also one of the three white males that hung the nooses in the tree. HE never served time and had the unmitigated gall (at the fault of HIS parents) to say Mychal Bell deserved to be in jail. It was a playground brawl and he was fine to go out three hours later. Assault charges I can see – not attempted murder. Also federal hate crime charges are in order too but I guess you all are too ignorant to notice that glaring omission.

    (4) I make one point and here come the nighriders, confederate soldiers, the KKK, neo-nazis all rolled up into one. If I inspire so much hate then maybe you need to look at your sorry selves. I put up an argument to one person in particular and everyone flies off the cuff. I thought this was about a drowning claim? Cliff did not make a valid statement about the Jenna 6 being victims. How many people have gotten away wih/have not been convicted by all-white juries/convicted in their old age due to racist acts? Please — if you don’t like what I have to say fine.     Let’s face it…. The kids who hung a noose from the tree, sent a message loud and clear to the black students of Jena. – Now, you may say that it was just a joke, and that the symbol of a noose, did not hurt the black students, but when you live in fear that a group of whites in 2007 can have a “Whites only” tree, you can understand why the black people feel hurt. – If it was a black kid beat up by a few whites, I suspect that you would be saying that it was just “boys being boys”, not even a misdemeanor. Frankly, I cannot believe that you are adults and the possibility that the people sitting next to me daily, think the same as you.

    Jim in Florida, lighten up. That’s the question I have asked more than once. As far as I am concerned it still is the responsibility of the parents. I see too many parents who find kids a burden rather than a privilege. I don’t know about these parents, but when my kids were that young they didn’t have this kind of oppportunity in a strange place. I really don’t think anyone here thinks the parents wanted this to happen, they just didn’t prevent it.

    Why is it everytime I read about some sort of lawsuit, racism always seems to raise its ugly head. I’ve read all of these posts and just keep thinking to myself, “how did it come to this?” I will agree that racism is still, unfortunately, alive but part of me feels that it is alive because some people will not let it go. I believe that ignorance exists on both sides, those of the racists and those that are not. We keep talking about personal responsibility and accountability and we have ripped these parents for this very such thing. My question is to those that try to find racism in every situation, when are you going to take personal responsibility and accountability and realize that racism does NOT exist in every situation? So please stop playing it as your trumph card and using it to try and get your way. I have no sympathy for those that do this, life is what you make of it and MORE times than NOT the reasons things don’t go right is because you made the wrong decisions. Everyone knows right from wrong and if you choose to ingore this, you must suffer the consequences. So be a true adult about it and take it like one.

    How about one of you being responsible enough to find out how the boy died. He was in the pool with a 36 year old family friend, and two other kids, got out to go to the bathroom. A few minutes later he was found dead. Life guard did not prevent a 3 year old child without a life vest from re-entering the pool unaccompanied. Family friend was probably distracted by two other kids he was with.

    My teenage son has spent the last 3 summers lifeguarding at the local country club. This summer, alone, he has saved 2 children under 4 whose parents were inattentive. (Mom was on the phone) In my opinion, members pay the big fees to buy the right to relax and NOT have to watch their kids! They have the expectation of security, and if it’s lacking, the club IS liable.
    As for monetary damages, I don’t see how the money would make up for the loss of a child. Actually, they are better off financially without the related expenses!

    Four years ago my oldest son graduated from Annapolis (Maryland)and when planning to attend his graduation my younger children requested a hotel with a pool. No easy task in Maryland as I was told many hotel/motel pools had been closed in response to a recent Maryland law requiring a lifeguard to be on duty anytime a pool is open. Appearantly Maryland holds pool owners to a higher standard than other states and that may be the reason for the high monetary award. If you don’t play by the rules stay off the playground. Having said that, I do agree that laws alone do not relieve parents of the responsibility for their child’s safety.
