Mandatory Seat Belt Bills Clear Virginia Senate

    this will probably not pass in the house again. this is a useless bill, because is it worth handing out tickets that charging $25 ticket? instead of speeding tickets that can pay $100+. now, if they violate another law and happen to not have a seatbelt on – sure tack it on, especially when involved in an accident… how many cops actually stop drivers with kids w/o seatbelts or in the front seat? sometimes we see laws put on the books and we don’t see things followed up by out cops… another good example is the headlights when you have your wipers on… i have seen many a car w/o headlights during a storm while they blades are moving across their windshield.. remember that was passed as a law, but i have to see a cop pull folks over for that… so where will this bill lead? nowhere! what is should do, if involved in an accident and you did not have a seatbelt, you insurance company need only pay 80% instead of 100%. i think this will put a damper on those not driving…

    These laws are only passed to enable police officers to circumvent the 4th Amendment and pull people over just to search their cars.

    My husband is a police officer…#1 – most do not pull anyone over when it’s raining, unless it’s a major offense, so the wiper thing is useless unless there is an accident & that would be a cause. #2 – he has pulled people over for not belting in their kids and if he can definitely tell the age, for the front seat violations. #3 – the main reason which has been spoken by a Virginia police department is that the reason they don’t pass this bill as it would be discriminatory & allow them to pull over more minorities for no reason to harass them…which we all know all police officers are racist…Good Senate, Bad House!

    not it does not give them the right to search your vehicle… they still have to have a warrant! now, if you give them permission, then they can search…

    Common misconception but not true. They can search any areas inside the car that you can easily reach, or go further if they see anything in plain view or something you say gives them a reasonable basis to search. of course, they needed a legitimate reason to pull you over to begin with, apart from the search. And the seat belt violation provides them with it. In states where you can pull people over just for seat belt violation, experience shows that it is discriminatorily enforced, as the people who actually get pulled over for not wearing seat belts or overwhelmingly minorities whom the police suspected must be committing some other crime.
