    this is why our courts get convoluded with cases and courts wind up being overly used by excessive lawsuits.

    1) how many of these planes have crashed before? how many of these planes if crashed was due to the weather?

    2) training? you’d have to prove that everyone recieved the same training and that it was laxed. but because you do train folks, does not mean that person will remember his/her training or they fail to live to those standards everyday. reason, is how many times have you seen videos of cops? how many of them you know are doing things correctly and how many have you seen do excessive? you these folks are highly looked at because of their presence within our community.

    training: how many of us have been trained behind the wheel of our own cars? and how many of you have failed to follow the proper rules of the road as you were taught? speed limits, stop signs and the like! how many of you get mad now, because they have cameras up and are now catching folks for doing some of the wrong things?

    now if you had an accident, do i see a lawsuit going after the insurance, you, the carmaker, then whoever trained you or even, the city who placed the particular traffic signal/marker, or what about that person standing near the road who caused us to glance out the window or and the list goes on and on and on! this is why lawyers need to stop! they are just fishing for more money for themselves instead of giving most of that money to the victim based on primary not seconds or thirds or more.

    As an experienced private pilot I can tell you that all accidents, ALL accidents are the result of pilot error. Pilots are trained for contingencies of every shape and size, from huge hydraulics failures, to failed rivets in the body of the aircraft. Responsibility for the flight and lives on board rests firmly on the shoulders of the pilot(s) (Per FAA regulations). Mechanical failure? Pilot should have seen this in the pre-flight inspection. Bad weather? Pilot should have reviewed all available info about weather before and during the flight. Mechanical failure during flight? Fly the plane to safety using the equipment that is still functioning.
    For people to feel the need to sue not only the airline, but also the manufacturer of the aircraft is ridiculous. The only ones responsible for the crash and ensuing deaths were the pilots, plain and simple.

    wudchuck, you are correct in your assessment of the attorney being the engine behind these lawsuits….remember the case in PA where the school district used a camera in their laptops to view a young man at home? the district got sued and they settled, no kidding, of the $610,000, the kid got $175,000 and the attorney got $425,000, not the usual one-third, two-thirds split. I am sure plaintiff’s attorney was only trying to protect the kid, and send a message to the school (more money, please!). so much for “pillars of the community”….
