New York Man Sues Bumble Bee Tuna Alleging Mercury Poisoning

    Hard to see how the supermarket as vendor could be liable here… Also wonder if there are any adverse affects or just the mercury level itself? Doesn’t all fish contain some amount of mercury and other heavy metal?

    first of all, he’d have to prove that every can he ate is from the same company and is all have the mercury level in it… how do we know if he had eaten something else that may have mercury, like barracuda or parrotfish or anything? now, he’s says he’s been eating these cans of tuna since 2006… now that means he’s been eating them for the past 4 years and during these many years has not shown in any medical test these so-called high levels of mercury. does not mercury poisoning cause damage after so long? so let’s see, 10 cans a week… thats 520 cans a year… thats 2080 cans over the past 4 years… and your going to tell me that all these cans have been laden with mercury… are you sure you did not drop your mercury thermometer in it and break it? are you sure that was not another way you could have gotten the mercury? sounds to me more like he’s fishing for more money because he’s too lazy to work or get more than just a can of tuna for a meal.

    From the FDA site (pregnant women are usually warned of the mercury levels in fish):

    Mercury occurs naturally in the environment and can also be released into the air through industrial pollution. Mercury falls from the air and can accumulate in streams and oceans and is turned into methylmercury in the water. It is this type of mercury that can be harmful to unborn babies and young child. Fish absorb the methylmercury as they feed in these waters and so it builds up in them. It builds up more in some types of fish and shellfish than others, depending on what the fish eat, which is why the levels vary.

    He didn’t have a heart attack. He got Mercury poisoning. The tuna is still heart healthy. Everything is toxic if taken in excess. Carrots are “eye healthy” but too many can cause vitamin A poisoning. The only thing safely consumed in mass quantities is tequila.

    So, you are telling me that I can potentially sue the city utilities because I drank 5 gallons of water per day causing hyper-hydration (water poisoning)? Hello! Know what you are eating and eat nothing in excess!

    King Mackeral and Tile fish are also suseptible to high mercury levels. As we say down here in the South, ” That ol’ boy ain’t toting a full string of fish.”

    perhaps he didn’t understand you are only supposed to eat what is in the can, and not the can itself. I would expect he has other problems than mercury issues since he has eaten 10 cans a week…

    my tuna doesn’t have a warranty, I get it cheaper that way. I do discard the cans, however.

    Let’s remember that he has not won the suit but only filed it. I see this as a calculated risk. Right now we all think the guy is a total moron. 10 cans a week works about to almost 1.5 per day. If he wins, he will laugh all the way to the bank. If he loses, he have shown himself to be dope who smells like fish (1.5 cans a day-yuck!) and he will have nothing to show for it.

    We’re going on his word!!???? Can he prove he ate that much tuna and didn’t really poison himself by deliberately ingesting mercury? Just another quick payday…

    he has it wrong – mercury poisoning isn’t his issue, being unable to get a date is!!! My cats don’t eat that much tuna.

    now, if that is a fact as it is written, sounds to me like this guy needs to be placed into rehab center at his expense for being totally clueless about eating so much of anything… would that not be like eating a McD’s for everything and claiming i got FAT BECAUSE…

    That’s right. I am going to sue NASA for failing to distribute warning labels on the dangers of excess gravity.

    Gravity, or more correctly, living in a gravity field such as our fine planet, tends to produce spinal injuries by causing the gradual compression and dessication of disks which leads to nerve root impingement and a host of other serious, loss-of-hedonia maladies. (Like plane crashes but I digress.)

    I myself suffer from occasional sciatica (PITA syndrome)as a direct and indirect result of gravity. NASA has a duty to warn the public and they failed to do so — willfully I might add.

    Now here’s the tie-in: Everyone knows mercury is heavier than air. Do you know why? That’s right: GRAVITY. Where do fish live and breathe? In the water. Water is always lower than the air. We breath air. Is tuna a fish? Of course.

    Hopefully, you can see where I am going with this logic. Tuna, forced to breath water, ingest mercury because of gravity. Then people like Mr. Excessive Tuna Eater consume tuna — and mercury.

    Had NASA issued warnings about gravity, Mr. 10 Cans, as any reasonable person would do, would either cut back or abstain from eating a lot of tuna.

    So once again, our Big Government has failed us. The bastards. They won’t stop until we are all victims.

    The only remedy because you can’t vote them all out of office at the same time, is to sue them.
