    It is realy hard to for the city attorney to mask the liability in this suit. If you cut through to the facts their is a link with the chain saw and the injury.

    um.. guess he should be out for the football team, because he had to run real fast from that awful pranking teacher… besides, why would any teacher do that in school? how was it allowed to be that tragically looking? does that mean if we had a science teacher with a broom and big pot – they are going to be using a live subject in a boiling project for a potion? um… good use of judgement by the parents for only asking for 100k and not millions…

    There is also a social cost with each and every situation like this one that depletes the trust between institutions like schools and the public, who are both entrusted to support ‘their’ public institution while having a need to trust the representatives of that institution are competent to do the right thing.

      If the kid falls while trick or treating it is his fault and the teacher should bare no fault.

    I wonder what sport a kid plays that runs away, on Halloween, from a masked person carrying a fake chainsaw………..

    So a 15 year old boy is running away from an obviously costumed teacher, not in frightt but in fun (I mean come on, the kid was 15). Sounds like they were both engaged in “horseplay”. Unfortunately as a minor there is no co-liability.

    I have to call BS on this one. The kid is FIFTEEN. We aren’t talking about a 5 year old. This is a teenage male. When I was a student, our teachers would do the same sort of thing. Guess what? We didn’t sue and didn’t “run” the way this kid did.

    The parents only asked for $100k as they are hoping the school pays without a fight. Very slick on their end. It will cost them that much to fight the suit, plus, the reputational damage could be severe for the district in terms of trust.

    Bottom line: This “male” ran from someone in a mask with a plastic chainsaw on Halloween… In a school…. It will never happen, but shouldn’t the court system simply tell the parents to get over it and tell the kid to stop being a baby? This is what is wrong with America.
