I have no quarrel with requiring insurance. My concern is whether or not claims will increase simply because the public knows insurance coverage is available to pay judgments.

“This bill is a victory for consumers. It ensures all dentists practicing in Pennsylvania have the proper insurance coverage. Gov. Corbett felt it was important to sign this bill into law to provide Pennsylvanians with protection and the peace of mind that their dentist has medical malpractice insurance in case they are injured in the dentist chair.”

It should read “This bill is a victory for trial lawyers. Regardless of whatever settlement their clients may eventually receive, the attorneys are assured of payment of their expenses and fees”

My assumption is that the majority of dentists already carry professional liability insurance as most of their insurance providers, i.e. delta dental require them to carry the insurance in order to get paid. Unless you are a cash only dentist, it probably wont affect many dentists.

It should be compulsory for all trades, not just dentistry. Leaving someone injured with no insurance to pay the damages is ludicrous.

Most dentists, I am sure, already carry professional liability insurance. I would like to see those statistics. However, if you read the proposed bill, you will see that the limits have been set at 1M/3M minimums. These amounts are probably higher than most coverages carried presently. This will encourage attorneys to go after dentists more aggressively, since the rewards will be higher.

Smells like the insurance lobby to me. One million in coverage is excessive and only invites litigation against dentists. Where is the danger in going to the dentist anyhow? Seems like 100k should be enough, but 10x that amount … for what? someone is making out on this and I will bet it is some crooked politicians and the lobbyists. Is a class action lawsuit in the works on this on behalf of Pa dentists?
