NY workers comp is very poorly run and rampant with fraudulent and inflated claims and under-reported and off the books payroll. Little or no effort is being given to fight fraud. Small contractors largely are working off the books and ‘under the radar’ since they could never afford things like workers comp, health insurance, tax filings and get any jobs from homeowners! Under the radar allows them to get subsidized health insurance or Medicaid; Sect 8 housing assistance, HEAP, etc, etc. What a mess!
And the NY State Ins Fund conveniently charges only a 10% assessment, while every other carrier in NY MUST charge 18+%. This insures that NY State can unlawfully take business from private carriers, when thier original intent was to be a “last resort” for coverage, a joke. Oh yea,they pay no commission to brokers who have to deal with thier inept practices on a daily basis
How about thier rediculous mandate that if you are an out of state business & set foot in NY you must show NY in item 3A of the dec page. What a pain that is for NJ risks provising services in NY.
Issuing uncecessary mandates without regard for the marketplace is common for these buraucrats.
Don’t even get me started on the State Fund aka the SFF! I will never again place a risk there after the way I’ve been treated – I don’t care if they are the only game in town left
Considering claims history, especially frequency and cost to manage a workers compensation program, employers, counties, and municipalities may be better off managing their own workers compensation program. Each entity needs a pro-active risk management department that understands that safety and loss prevention is foremost at ground level, face to face with all employees. More important is the communication that is established and maintained between the workers, supervisory, senior management, and risk management, safety, and claims staff. A workers compensation program can only be successful if everyone works together. Education and prevention will have a far greater affect in controlling cost in benefits and litigation.
I cannot get WC coverage. I have been in business for 14 years with only 1 claim for 87,000 2 years ago from an employee falling off ladder from 4 feet and breaking his leg and jaw. What do i do?? I cannot stay in business without WC, and my ex partner owed the NYSIF 10k, which was supposed to be written off through my personal Ch7bk.. Any advice?
