    I hope I read it correctly- the deceased man is the barred driver who had no permission? At least he didn’t take anyone else with him.

    Hmm. This one appears to be what Ed Asner would refer to as a “no-brainer!” Macie knows her boyfriend Kim has a lifetime suspension, but why in God’s name would she give the keys to Colby, whom she DIDN’T EVEN KNOW? I say her insurance should cover because Colby happened to be a Good Sam at the wrong time; if anything, Macie should’ve walked Kim to the car, unlocked the trunk and turned on the radio without leaving the keys in the ignition, presuming the car itself is a late-model with that capability.

    BTW, what’s up with Kim hitchhiking in VT, while the girlfriend’s job is across state lines in NH? (Maybe there’s more to the story..?)

    I think you’re missing the primary reasoning here. The guy KILLED HIMSELF in an accident and is suing (posthumously through the fam).

    Knew of the multiple convictions – obviously NOT trustworthy and no respect four authority. In the face of that knowledge – gave him the key. Shouldn’t have trusted him with holding a door open, much less possible access to a motor vehicle.

    the last paragraph seems to be missing. “Colby saw Lamotte later that afternoon and told him he should not be driving. Lamotte got back in the car and, a short time later, drove it off the road.

    “Essex County State’s Attorney Vincent Illuzzi said that Lamotte was decapitated by a utility pole’s support wire. Illuzzi said he investigated with an eye to bringing a criminal charge of accessory before the fact against Colby. But he said because the passing of the keys occurred in New Hampshire, he did not feel he could bring the case in Vermont.”
