Swimming is one thing; DIVING into the pond is totally another and created a regrettable situation, not worth $31Mil.

Guest: “Boy, it sure is a hot day for a wedding. Hey, there’s a pond!”
Waiter: “Can I get you another drink, sir?”
Guest: “Sure, you read my mind! By the way, can I swim in that pond over there?”
    Waiter: Shrugs. “I don’t care.”
Guest: “Woo hoo! Last one in’s a rotten egg!” Dives headfirst into a POND.

Not really trying to make light of a tragic event, but anyone that of their own free will dives headfirst into a POND should have to bear some of the responsibility for their own injury. With a $31M verdict, now campuses around the country will have to remove any landscaping that involves water, or else fence them off and place ‘No Swimming’ signs everywhere.

Admittedly, the article doesn’t provide a whole lot of detail, but from the information given, this just seems like a lack of common sense. Sad for everyone.

There is negligence spelled out everywhere.

What about the old adage don’t dive unless you know how deep it is or what’s in there?

    $31M and zero personal responsibility.
