Maryland Appeals Court Says Insurer Has Duty To Defend in Hidden Camera Case

    “Harleysville argued that to have a right of private occupancy in a room, someone needs to have a possessory interest in the room. Because the plaintiffs lacked any interest, Harleysville contended their claims did not fall within the coverage grant.” !!

    When I am using a public restroom, for its intended purpose, I do have a possessory interest in the room and do expect privacy.

    Perhaps we should visit Harleysville’s offices and visit this attorney/claims manager in his ‘office’. (bathroom stall) He may have a different take on right of private occupancy at that point!

    We have a reasonable expectation of privacy in a public bathroom. Unless of course illegal activity is taking place and is suspected by Police.
