Conn. Supreme Court Finds Insurers Not Liable for Crumbling Foundations

    But the court did NOT say these same insurers have no responsibility for the costs homeowners must incur to repair other structural damage to their homes which resulted from the shifting defective foundations, every home has sustained “other structural damage”. And what about the expenses homeowners must incur to raise the structure so the defective concrete can be replaced? The policy REQUIRES homeowners to protect their property from further damage and that is the only way to do that. These costs should be a covered expense. And how about the additional living expenses these homeowners must incur for temporary housing while the repairs are being made? Those additional expenses should be covered, too. Some homeowners have recovered the cost to repair other structural damage from their insurers. Why not everyone? Isn’t there more to this story?

    Why doesn’t the CCACB share this information on this potential source of recovery with the impacted homeowners they are claiming to be helping?
