No Charges in New York Fatal Crash Involving Sleeping Deputy

    So, a person is killed in a vehicle accident, through no fault of their own, and nobody is held accountable? There is something wrong with this issue.

    I presume there is some contributory negligence or liability, due to the circumstances, if the deputy elects to drive his vehicle and does not take measures to pull over, stop, or not drive once they recognize they are tired.

    I wonder who the AG is protecting in this case, because it does not appear to be public safety.

      You’re correct on the contributory negligence issue, but that’s a civil court situation. I think, while we didn’t see any criminal charges, we will most likely see a civil suit and corresponding large settlement from the victim’s estate.

    What Mr. Integrity seems to misunderstand is that we have two systems of justice: Criminal and Civil. It was an un- intentional accident. Damages will awarded in the Civil Court system. There was no evidence that a criminal wrong was committed.
