Ohio Doctor Can Be Sued in Inmate’s Suicide: Update

    The inmate was “denied access” to Tepe. I know the Federal courts are full of wealth re-distributionists, but how is this Tepe fault? I think the answer is that it isn’t his fault, but he’s a deep pocket. The lawyer will have better luck going after him than the prison officials. Given the important role parents have in the emotional development of their kids, am I the only one that sees this as being a bit ironic.

      Maybe Tepe denied him access. I love how everyone is SO quick to judge everyone else on 1/2 a story.

        The article stated, “he was denied access.” Which would mean that someone else other than Tepe denied access of the inmate to Tepe. So, perhaps the article was written incorrectly. For me, it just seems Charlie is recounting what he read and his opinion on the current outcome of the situation as stated in the article. So, Tepe should not be held liable for the inmates death.

        Dont we as business people have the Right to Refuse Service to anyone? Whats next, a drunk suing a bar because he was cut off?

    Why can’t we see the positive in this? Think of all the taxpayer money that has been saved by the inmate hanging himself! Forget the lawsuits and move on. Perhaps if his parents had been better at their job, the guy would not have ended up in prison in the first place.

      Why are you so quick to blame the parents? Remember Cain and Abel? Both had same parents–only one turned out bad. Sometimes it is NOT the parents that causes a kid to make bad decisions. What was he in jail for anyway? Maybe he did have a mental disorder or was severly depressed or suicidal and that was the reason he was in jail. Without all of the facts it is hard to really make any kind of informed judgement in this case of who was at fault. As I and many others have stated many times, the people who are writing these articles have a terrible habit of leaving out important information. So we are left with only part of a story and have to draw conclusions that are probably incorrect. But maybe that is their strategy. Maybe they get more interesting posts that way.

    True, we don’t know the whole story, but I’d like to know when people are going to stop blaming everyone else for their tragedies. It’s very sad, but this person CHOSE to end his life. That is no one’s fault but his own, and while I understand that his parents are probably heartbroken, I don’t see what a lawsuit is going to accomplish. It’s certainly not going to bring him back.

      That is the case here. It is still human life and from what the article states, it may have been able to be prevented if he was allowed to see the therapist

    Sometimes it is not about the money. Sometimes a lawsuit is the only way a family has to call attention to a problem. Think of it this way. If your son had a mental illness or was suicidal and was denied care that would address that illness that would be the same as if he was bleeding and no one called a doctor or tried to help stop the bleeding and he bleeds out and dies. You can’t have the police arrested. So what can you do? You file a lawsuit and make it public that someone did not do their job as well as they should have. This article hardly gives enough evidence to say for sure what was going on. It very well may have been someone’s fault that the kid killed himself. Aren’t the police suppose to make an assessment and if they feel the kid is even remotely at risk of killing himself he should have been put on suicide watch. How did he manage to kill himself? Did the police take away everything that he had on him that could be used to do himself harm? They are suppose to. What was he in jail for? Was he on drugs? Did that keep him from making sound decisions? Don’t judge too quickly. Not everyone who files a lawsuit is just someone out to get rich out of tragedy.

      Cases like this are very fact specific and this story is light on the facts. The story is really about the fact that the doctor can be sued and is not immune from liability. Unfortunately there are suicide attempts in jail and some times they succeed. Liability stems from the jail and healthcare worker’s responsibility and that is where the specifics come into play.
