Court: Iowa Farmers Who Host Tours Can Be Liable

    Once again the lawyers and the courts only see the law through dollar sign glasses. A farm is a dangerous place. Any reasonably intelligent adult should understand that fact. Because the farm owners were nice enough to open their farm to the kids, they now face a lawsuit.

    Going forward, any farmer, businessowner, or even homeowner that is allowing the kids to come out need to be listed as an additional insured on the school district’s policy and have a hold harmless agreement in place.

    This is absolutely a killer for school activities. Thank you attorneys.

      Actually, I think the better solution would be for the school district to include volunteer coverage on their work-related injury plans, whether a self-insured WC plan or ERISA-type coverage.

      They likely already go through an application process with background checks, etc.

      But I do have to ask — why in the world

    This is insane. How are we suppose to teach children where their food comes from. What about hunting, snowmobiling, horseback riding???? Hope Iowa government will see the loss in revenue. Letting some sue happy person get by with this. I hope someone ruins this lawyer’s and lawmakers Memorial Day weekend like they did mine of horseback riding on private ground in the rolling hills of Fayette County.
