Debate on Workers’ Comp Reform Begins in Illinois

    They should have brought some field agents in to discuss what goes on at the street level.

    The specific reforms advocated by Governor Rauner do not appear to be genuinely focused on what’s been making Illinois Workers Comp more expensive than neighboring states–which is the cost of Permanent Partial Indemnity claims. Rauner’s proposed “reforms” would restrict benefits to some injured workers, but do not appear likely to reduce costs for most employers in Illinois.     I got hurt at work 05/16 and i’ve been put thru hell. It took months to get my workmans comp even started though i was going to my doctors appt and therapy appt and doing all i could to get better to go back to my job. When i finally did get my workmans comp checks which is way less than i make at my job….they was not always on time. Why would anyone want to be on workmans comp….you have to deal with lawyers which avoid you if they have nothing good to tell you….you have to go to doctors and therapy all the time which are a far distance from where you live. You have to deal with the insurance company that does everything possible to not pay you. You have to get painful injections in your back. Your good credit goes to hell….you can’t pay your bills….your in constant pain…..you can’t do your everyday things you need to do….oh yeah sure i want to be on workmans comp….not! You can not live off the money and its nothing but a pain in the butt! So i did my therapy got 2 injections in my back and felt somewhat better so i ask my orthopedic doctor if i could return to work, he had a surprised look on his face and said do you think you can i said i want to try so he let me go back to full duty no restrictions on a trail basis. Well i went back to work and did my job which is in a warehouse lifting all day pulling twisting bending and standing and kept my mouth shut even though i was in pain. Two weeks into it i was sitting on a stool labeling boxes and the supervisor in put away comes in behind me with a fork lift and picks up a pallet of boxes and while doing so pushes the pallet of boxes into my back. Now mind you he isn’t even suppose to be in this area with a fork lift picking up pallets. I lasted about 9 weeks back at work, i started having numbness and tingling in both my feet which makes me off balance. So i have been out of work since 02/13 with no pay and it is now July. I ask my lawyer before i returned to work if it was where i couldn’t do my job and had to go back out on workmans comp would it take as long as the first time to get my workmans comp checks started again and she said oh no it will start right back up. Well guess what it is taking longer then time. They sent me back to the doctor i seen before for another independent evaluation who said the samething as before he had no doubt that my accident at work caused my disk in my back to rupture. I spoke with my lawyer a week after the evaluation and ask when are they going to get my checks to me and she said it could be 30 to 45 days. Its unbelievable what you have to go thru no fault of your own….we have no rights now and they wanted to make it harder….what a joke. The worker needs more rights…..the business has all the say the insurance company has all the rights to play there starve you out game. There should be some type of laws put in place that give the insurance company a time limit on how long they can wait before they start your workmans comp pay….they are the ones that need put in the place. So here i sit once again waiting on them to send my checks all the while im behind on my bills and ruining my credit so do you really think i want to live on workmans comp and put up with all this crap??
