Indiana’s cap on medical malpractice payments would be increased for the first time in decades under a proposal in the state Legislature.
A bill endorsed by Republicans who control the Indiana Senate would boost the state’s current limits on what malpractice victims could receive by $400,000 to $1.65 million. The proposal would also allow the limit to increase every four years based on the national inflation rate.
Senate President Pro Tem David Long says he believes the cap has helped hold down medical costs in the state, but that it should increase to meet growing expenses.
The current cap is being challenged in court, and Long says he worries that not allowing for increases leaves it vulnerable to being ruled unconstitutional.
