An Ohio roofing contractor has been cited for the sixth time since 2012 by federal workplace safety regulators for failing to ensure workers used required fall protection equipment.
The U.S. Department of Labor’s Occupational Safety and Health Administration cited Ivan Lowky operator of ILS Construction in Hartville, Ohio, for failing to provide require workers to use fall protection equipment while they worked on the roof of a three-story apartment building in Canton, Ohio. Five workers and Lowky – their employer – were found to be working on the roof without necessary fall protection despite having the equipment available, OSHA said.
On Nov. 3, 2020, an OSHA inspector observed Lowky and his employees using nail guns to install roofing material without fall protection. OSHA cited ILS Construction for two willful and one serious violation, and proposed $117,572 in penalties.
The company has 15 business days from receipt of its citations and penalties to comply, request an informal conference with OSHA’s area director, or contest the findings before the independent Occupational Safety and Health Review Commission.
