    Anyone who is facing a layoff or suspect you will be laid off –please brace yourself. Your nightmare decent into hell may have just begun. A fair number of employers are lying about layoffs, trying to cheat people out of unemployment benefits by stating they were fired for misconduct. Your fate will lie with the decision of a judge. Keep a paper trail. Get everything in writing. Keep in touch with other former employees. Justice will prevail. This happened to me and I spoke to a business acquaintance last night who told me her office fights tooth and nail to deny unemployment benefits to everyone they lay off.

    Some employers will use layoffs as an opportunity to get rid of older employees and those with disabilities or perceived disabilities. An HR consultant recently discussed how prevalent this is from an inside perspective. Although employers will say that employees sue more for discrimation after being dismissed during a recession, the reality is that there really is more discrimination during recessions as some employers use this is an opportunity for “housecleaning.” As B. Ware says, document, document, document.

    That’s unfortunate and terrifying. I’m just wondering…what does an employer have to gain by trying to get your benefits denied?

    Employers pay an unemployment “tax” and in many if not all states this “tax” is experience rated so they fight to keep the cost down.

    DUH. THERE IS NOT REALLY ANYTHING NEW IN THIS STUDY, BUT I BET THE AUTHOR PADDED HIS POCKET AND IT PAID HIS SALARY FOR A COUPLE YEARS WASTING SOMEONE’S MONEY TO COME UP WITH THE OBVIOUS. THIS STUFF IS HR-101.
