I think Obama is waiting to nominate another justice. That is why they want it delayed. Any idiot can read the US Constitution and come to the conclusion that it is unconstitutional. I really do not think this Country has lived by our Constitution in my entire lifetime. It is very explicit and detailed as to the jobs of the Congress, The President, The purpose of government and the restrictions of government over the people. The founding fathers were very detailed as to what is acceptable from our government and what is not. For one thing, when did it become ok for the president to put us in war, without getting an act of Congress? It is being done over and over now, by both republicans and democrats. IT IS INFURIATING! Only congress can declare war!. Our government better start living by our constitution or one day we will wake up to a dictatorship.

If you are referring to Bush, he did get approval from Congress before he went to war in Iraq, as well as from the UN.

An issue this important that has been so widely debated in the country and they are taking a 3 month vacation? Goes to show you that our wonderful Supreme Court are the ultimate elitists. They have their guaranteed Health Care and a lifetime appointment. To heck with the rest of the country and getting this handled. This case is not likely to be heard before the next election which is exactly what Obama and Holder want. Keep on wasting that money doing implementation of the exchanges etc. Thank you Supreme Court for shirking your duty to the American people.

Sarah, who says “I think Obama is waiting to nominate another justice. That is why they want it delayed.”

You think wrong. The justice most likely to retire next is Ruth Bader Ginsberg, who is the oldest and whose health is most frail. She’s on the liberal wing of the court, so replacing her gets you nowhere.

Nothing is ever so black and white that “Any idiot can read the US Constitution and come to the conclusion that it is unconstitutional.” If it was so black and white then you wouldn’t have some courts say the law is constitutional and soe say its not. It’s a tough call.

And to Underwriter below, President Bush did not get a “declaration of war” from Congress for Iraq, which is what Sarah is referring to. The last declaration of war in this country came after Pearl Harbor.

What Presidents use now is the War Powers Act which allows Presidents to do what President Obama did in Libya so long as he gets approval (not a declaration of war) from Congress within 60 days.

Bush may not have gotten a Declaration of War, but he certainly got approval and funding for it. As a matter of fact, most Democrats back then including Hilary thought WMD’s were there and we needed to take Sadam out. All the Intelligence Services in the world and 17 UN resolutions later had everyone convinced he had them and would use them. Truman, a Democrat said Korea was a Police Action. LBJ, a Democrat used the Gulf of Tonkin incident to get approval for getting seriously involved in Vietnam. FDR, a Democrat purposely got caught with his pants down on Pearl Harbor so we could get a Declaration of War against the Axis. We are still waiting for Obama to get his act together for Libya. Another overseas contingency action? We shall see.

this health care dedacle is just like the housing debacle. Democrats want everybody in a house even if they cannot afford it and never make the first note, now all housing prices have dropped like a stone. All health care will become mediocre in future, like schools have been dumbed down.
    A sick way to be.

It seems like everyone is talking about the constitution on this issue, and of course, attorneys specialize in constitutional law and devote their entire careers to argue cases like this in court.

But really, what is constitutional? Should my tax dollars go to social security, medicare, medicaid, and all other forms of “American Socialism”? Is that “constitutional”? If we restored America to its “constitutional” state, what would life be like here in the center of the free world? Would we still want to live here?

Basically, we are wanting our country back and the Socialists want to take it down the road to a totalitarian nanny state similar to Chavez in Venezuela or Castro in Cuba. The Constitution was written by very wise men who saw the dangers of big government and wanted to limit government to defend the country and not much else. Now, the Progressives in the past 100 years and particularly since FDR want a nanny state and government to take care of us from cradle to grave. Just look at the mess they have created. It is nauseating to watch. We are at a tipping point and something has to change and government must be reduced at all levels from the Federal down to States, Counties and Municipalities. We are broke.
