Facebook faces numerous challenges in the near future. They are a liberal site who also wants to squelch Conservative opinion along with Twitter and Google. Hope they get what they deserve.

“The companies could be fined $1,000 to $5,000 each time a person’s image is used without consent….” The billion dollar question is – how will the court define “consent” here?

In order to tag someone on Facebook, they first must have a Facebook account. I’m guessing in the 750 page Terms and Conditions nobody reads that FB’s attorneys added a clause saying “you implicitly give us consent to use your photos and improve our DeepFace technology. Should you wish to revoke your consent, all you have to do is “untag” yourself from any photo you’ve been tagged in.”

Considering FB provides notice to anyone who’s been tagged in a photo via a notification, FB could argue “we told users when they were tagged and that such tag would be used to improve our DF tech, and therefore we gave notice to those users of their ability to reject consent by “un-tagging” themselves.”

Legal Consent = clicking ‘ok’ on their EULA. Oopsy!

Exactly … why do you think they make you click the box that says “I have read and understood this agreement” before you can proceed?
