This should be a rich field to pursue by Trial Attorney’s. Than can sue anyone who made any part of the car or who had put the car on the road. Products/Completed operations limits will be exhausted in no time as well as Umbrellas.
The “NHTSA publications have attributed about 94 percent of auto accidents to human error” canard has been widely and erroneaously stated to imply machines can save lives. The report never uses the work “human”. The report distingushes operrating errors and mechanical errors; and in no way considers automated driving systems. The report focused on “critical reasons” for crashes, which were “not intended to be interpreted as the cause of the crash nor as the assignment of the fault to the driver, vehicle, or environment.” The report makes clear that none of the 94% cited “was the assignment intended to blame the driver for causing the crash.” Instead, that 94% of the reasons were identified as recognition, decision errors, performance, and non-performance driving operations.”
The more accurate and salient conclusion from the findings of that report is that ADS must be able to assume those driving operations that have been the reason for 94% of crashes.

The existence of auto-correct errors, not typos, in the above two posts do not bode well for safety of humans in machine controlled autos.
