IBM Being Sued for Age Discrimination

    I don’t disagree with IBM in the following comment, “IBM has argued change in its workforce is necessary to stay fresh and competitive”. But I do disagree with them in how they compensate the “older” employees to achieve that objective. The reality is that youth are change agents, not always, but for the most part. Given how quickly technology changes, it makes sense to hire “fresh” ideas. But! You are IBM, come on! Your desire for “fresh” talent does not relieve you of your ethical obligation to the workforce that made you the giant you are today. You can afford to compensate them to retirement and to do anything less is unethical and greedy. If IBM fails this ethical test, the youth will notice. I believe it will impact their ability to attract the “fresh” talent they desire and it will backfire.

    I gave the best years of my life to IBM, working through weekends and vacations. After over 20 years of service I was laid off and my severance was cut from 6 months to 1 month. The irony is that with a family you take what they offer you and move on; I didn’t have the luxury of leaving that money on the table or I would have. It was an insult. I can’t blame IBM for doing what they have to do to survive. The real responsibility lies with the globalists who exposed us to worldwide competition too fast and recklessly. They let China, Mexico and everyone else cheat against us in lopsided trade deals and allowed our technological advantage to be pilfered. A weakened IBM which is bleeding too much to afford to keep the implied promise of severance is the result. The lesson is we need to stop expecting Corporate America to take care of us and instead go for contracting jobs that pay a higher cash wage. Then we can save up our own ‘severance’.

    I am also affected by this massive lay-off back in June 2018 in Canada. I worked for 20 years as a technical support engineer and over time pay was also cut. I was going to 50-year old in November 2018 and was forced to leave IBM with no good justification. It had nothing to lack of workload. Me and my colleague were also affected and we were also around that age-range. The only person in my team did not affect as he has worked there over 27 years and he is a senior. In my mind, the senior should be affected first as he has highest salary and he is also 55 year old. Beside Age Discrimination and it is also who you know in the company to save your job. The top level management team members are also known this senior person as they were working together at one point in time in the past. They look after each time for favor. I like to add my name in this lawsuit as I am not happy about it. How to do I add my name to this lawsuit? Please let me know. Even worst, even I have extremely strong skill in the team, I still got lay-off. Unbelievable. What I found out after a few weeks later trying to apply internal jobs that fit by skill set, no one seemed to take me because I am in the lay-off black list regardless whether you are qualified for that position. Very very sad how IBM treated employees.

    I was put in a “resource action” 2017 but never signed a waiver (simply by accident) but I did not get my severance (1 month, big whoop after 23 years of service). I have seen wave after wave of “resource actions”. As the financial advisor for a VP on a large services contract, every quarter our leadership team meetings centered around how would we meet targeted headcount reductions from HQ. IBM specifically went to small quarterly cuts.to avoid bad press and conceal it from the public. My skill set was up to date and received 1 or 2+ rating every year.
