The NHTSA doesn’t take such actions without deliberating the matter carefully. The FTC has the ability to make an informed judgement in the dispute. So far, all 3 parties are making the typical public statements about the matter; i.e. they did it, we didn’t do it, and we don’t comment on ongoing investigations. Tesla is likely trying to protect its reputation, so it’s possible they have made incorrect claims. The degree of exaggeration is what the FTC will assess and act accordingly. I suspect there may be some fines imposed, with Tesla making typical denial of fault statements after they pay to make the matter go away.
