    Although these cases are unprecedented, Judges now have to come to the realization that “going by the book” is no longer clear cut. If they side with the Employer it is another cog in the wheel against the average worker who has to take it in the foot once again. Corporate unfairness. Chances are, people are getting sick from being at work but no one wants to admit there is any blame.

    If a spouse can sue claiming she got COVID from he husband’s workplace, then a spouse can sue if she caught a bad cold, the flu, or any other illness that caused he to be hospitalized. Also, how can she prove it was from his workplace. That is hypothesis!

    This is a very slippery slope and another reason not to own a business in California!

      What slippery slope are you referencing? Did you miss the part of the article that said “if the case proceeds they’ll have to prove that Robert contracted the virus at his workplace — a difficult hurdle for all Covid suits.”?

        Many states have enacted legislation or have executive orders which presume a person became infected at their workplace. The burden is on the employer to prove that is not the case. California was one of the first states to create this presumption, with the goal of forcing such claims into WC programs. While that presumption may not apply in the tort realm, it certainly will influence those courts facing these types of cases. And btw the judge in the case referenced in this article is not correct – this is not the first such lawsuit. One such case was filed in NY months ago.
