    Texas workers comp is normally the sole remedy for injuries, unless the employee dies. The death can be at the time of the injury or later. However, in order for the plaintiff to prevail, they must prove GROSS Negligence, not just simple negligence. This is an extremely high burden. The speed of this suit would indicate no determination of type of negligence.
