I am not sure there really is an issue here. In the multiple billion dollar judgments against Johnson @ Johnson for talcum powder injury, the issue of causation was questionable and the successful plaintiffs couldn’t even prove they bought J @ J brand product. The trial court refused remittitur or a new trial, nor did any appeals court find the verdicts excessive. This year the US Supreme Court didn’t grant Cert. so the billion dollar verdicts must not have offended the conscience of any court. Using the J @ J verdict as a benchmark, the Charter case seems for more definititive and egregious, and I can’t see where $7.5 would be comparatively out of line.
