Investigators from the California Department of Insurance (CDI) Criminal Investigation Branch’s Fraud Division arrested a San Bernardino man on seven counts of workers’ compensation insurance fraud.
According to the CDI, Juan Carlos Garcia, 33, was booked into the San Bernardino County Jail, with bail set at $25,000. If convicted, he could be sentenced to up to five years in state prison, and face fines of up to $50,000.
The investigation revealed Garcia allegedly presented false statements to support his injury claim while employed by Mr. Clean Maintenance Systems.
Garcia testified under oath in WCAB hearings that he had not used drugs or alcohol within six weeks of a routine drug test and had not played soccer since his alleged injury, except with his son on a limited basis.
Investigators say their examination proved otherwise.
Kemper Insurance paid approximately $9,000 in medical and investigative costs as a result of this claim.
