    Again. It is not about the attorneys. So what if they get a percentage of the benefits? This is about injured workers. You don\’t get it, you conservative greedy people. All of this misery caused to injured workers who have lost their homes, cars, and employment to punish the lawyers? The greed is appointed to the insurance companies. How can you sleep at night? I know, very well because you can now afford a better mattress to sleep on while injured workers sleep in their cars. I am a registered Republican and I am ashamed that I voted for Arnie. He has forgotten what it is like to be middle class. I am so surprised Maria didn\’t whisper in his ear and told him this would affect the very people who voted for him. This person will not vote for him.

    The Applicant\’s Attorney\’s Association does not like the fact that the Permanent disability has decreased because it effects the amount of attorney\’s fees they would have received. The attorney\’s aren\’t getting paid as much as they were before. I don\’t feel the least bit sorry for the applicant\’s attorney\’s.

    Remember – VotersInjuredatWork.org was set up by the CA Applicants Attorneys ASSociation. They\’re one in the same. Right off the bat, I wouldn\’t give any credience to what their report says.

    That being said, I saw abuses on both sides – carrier adjusters doing their best to deny PD where it was warrented, and the sharks on the other, trying to get doctors to give a higher PD rating than what was warrented.

    Our agency suffered two LARGE losses that were both bogus – the fraud is rampant and it has to stop. We were victims twice and we are in the business. Perhaps cutting benefits will go injured workers back to work in a more timely manner. One of our losses involved a relative and I know what she was doing the entire 2 years she was off work collecting disability – and it wasn\’t being disabled. Why this information was not taken into consideration when the claim went to court is another problem that has to change. I know many others who have similar stories. I know that there are legitimate claims out there, but, unfortunately most of the ones I have dealt with aren\’t. I doubt that the number of people sleeping in their cars because of a work comp claim is a very large number, especially when compaired to the number who are totally cheating the system. We have to get rid of the fraud and to do that, we have to make it less fruitful for those who choose to take that route.

    I would love to share my personal experience trying to get my case closed and move on with my life. It is now 5 years and finally it looks like my case will be closing. The W/C Insurance company has in the five years had 6 law firms work on the case, firing one firm and hiring another. The reports and exams varied by law firms, building there legal fees and ignoring doctors reports. It did not change anything except that the insurance company can now say that its cost of doing business is up and the bottom line is effected. They will I\’m sure raise fees to compensate there cost.Leaving the employers with higher costs or the injured worker with less coverage and assistance to resume there life.
    The DOI should monitor how an Insurance company handles the claims and have time restraints. I have been retrained and am now working and starting my new career at 58. Its hard enough to get work at 58 in a new career without medical problems, ad medical problems and its even harder. Under the law, age is taken into the equation at the time of injury not when its settled. There was no incentive for the insurance company to settle. To sum up my response the W/C changes should effect how claims are handled by the insurance companies, and the law firms and the W/C doctors. The entire system needs to be reworked.

    WC insurers took in 24 billion in premiums from California Employers and paid only 8 billion in benefits in 2004. They will fit right in with ENRON and oil companies gouging the American People for profit.

    So Chuck, if the State controls about 50% of the written premium in California and WC profits were 16 billion, then the state has about 8 billion in profits? I think the state should control 100%. How about you comrade?

    I have to say that I agree with what some of you say. Fraud is rampant and has to be stopped. But the problem is, those who are really hurt are getting screwed. I would know, i am on W.C. I used to make anywhere from $450-$600 in the medical field. Now on my permanent disability, i get $400 every 2 weeks. How am i supposed to pay my rent of $850? I\’ve been eating with people who have been helping me out since i got hurt, because i can\’t afford to buy food!

    You can take the attitude of screw most of the bad people, and sorry for the ones who are hurt. This is a situation where we need to spend more money to save money. Spend as in have real people look over each case! The money the state can save is substatial. And those caught will have the money they owe and are fined taken straight out of their pay checks!
