The Chartered Property Casualty Underwriters Society’s California El Camino, Los Angeles and San Gabriel Valley Chapters are hosting a Contractual Risk Transfer seminar on Thursday, April 20 in Pasadena, Calif.
The program is designed to help attendees:
*Understand “contractual risk transfer” as a non-insurance and an insurance technique;
*Understand why statutory limitations apply to contractual risk transfer, and why there are exceptions;
*Distinguish among various categories of indemnity agreements, and understand why some may be void and unenforceable;
*Identify potential defenses to indemnity;
*Understand the mechanics of third-party-over actions;
*Identify potential problems when working on specifications calling for contractual liability insurance;
*Avoid potential problems when arranging both contractual liability and additional insured status;
*Assess the coverage grant of CGL, policies in providing contractual liability coverage, and identify pitfalls associated with this coverage; and
*Understand the scope of protection, and the difference between the rights of an indemnitee under a commercial general liability policy versus an indemnitee who also is a additional insured.
The featured speaker is Donald S. Malecki, principal at Malecki, Deimling, Nielander, & Associates, based in Erlanger, Ky. During his 45-year career, Malecki has worked as a broker, consultant, archivist-historian, teacher, underwriter, and insurance company claims consultant,. He is the author of 10 books, including three textbooks used in the CPCU curriculum. He is past president of the CPCU Society’s Cincinnati Chapter; a member of the AICPCU examination committee; an active member of the Society of Risk Management Consultants; on the CPCU Society’s Consulting, Litigation, & Expert Witness Section Committee, and a past member of the Commercial Lines Industry Liaison Panel of the Insurance Services Office Inc.
