The senior citizens in the AZ senate have been out in the sun too long if they think there’s anything to debate. Comparing texting to eating or changing a radio station aren’t valid comparisons. Neither of those activities requires any significant amount of time and focus to perform. Texting requires two hands in some configuration, and a significant amount of time looking at the keys and message. It is a totally UNECESSARY activity for idiots who can’t concentrate on their primary responsibility of driving a car. The “instant gratification” and “entertain me” generation thinks just because there’s a portable communication device, that it’s OK to use it in a car. That is a pile of crap and most sensible, mature people realize that. NOBODY aside from medical professionals and the president are so important they need to be “in touch” 24×7.
This is a waste of time. The city of Phoenix implemented a texting ban last year with similar provisions. However, it’s been found impossible to enforce. If an officer pulls someone over for texting, they can not require the driver to show their phone without a search warrant. Thus, they are unable to issue a ticket. It hasn’t been tested with an accident that I’m aware of.
There’s a simple solution – if someone is driving recklessly, pull them over for reckless driving. Whether it be from texting, talking on the phone, talking to a passenger, lighting up, etc. If a driver is swerving and endangering others, they can be cited for reckless driving.
How about the officer just gives the ticket and leaves it to the person to provide proof, at a later date, that they were not texting around the time of the pull over. If the person wasn’t texting as alleged, their phone records should show it.
Congratulations Republicans who voted down the proposed anti texting law for the state of Arizona. You just spit on the graves of those who are dead as a result of foolish stupid texting drivers. Their blood is now on your hands.
More insanity….Reckless driving is already on the books. Texting and driving is stupid but so is surfing the internet on your phone or tending to your mouthy kids. This is just another excuse for pirate cops to harass everyday people and rake in revenue for the STATE. There is NO possible way to truly know if someone was texting or dialing a number.
