California Insurance Commissioner Seeks Disability Changes

    Wow, the two biggest windbags and publicity hounds will be battling it out to be governor. It might be time to move full time to my cabin in Wisconsin.

    I applaud Mr. Poizner’s efforts and courage to reduce regulations. Mr. Garamendi’s stated purpose for his strong opposition is consumer protection, but if one examines the ramifications of the these regulations the consequences are anything but consumer protective.
    Some reasons these regulations hurt consumers were mentioned in the article – higher prices and the the loss of employer sponsorship as a result. But there are many others. If insurers can;t offset other income after disability they cannot issue as much coverage pre-disability. That affects all consumers not just the ones who ultimately receive other income benefits. In my experience less than 50% of private disability claim recipients qualify for other benefits. Additional regulations cause higher administrative and compliance costs not just within insurance companies but also within the state. Partially as a result, the time lag for CA to review new disability products is measured in years, so consumers are denied benefits of products available in other states and reduces the number of companies willing to write insurance in the state. I also agree with Mr. Poizner that the Insurance Department and Commissioner already have the power and authority to regulate insurers without those regulations. Mr. Poizner obviously believes that his job is to spend his department resources protecting consumers from the abusive practices of the specific insurers who perpetrate them, rather than in making arbitrary rules that do not protect the public he serves. Mr. Poizner’s job definition is a lot harder but also more caring – I wish him success.

    is it a wonder california is listed along side the US, like we are a small country outside the USA, feels like it at times! we have the highest cost in almost everything , now worker’s comp.. way too many taxes and such for me.

    My LTD carrier has completely cut off my benefits because “I owe them the SSDI I was awarded”. Talk about hardship! I am entitled to monetary benefits through 2024. Why can’t they handle the offset by paying me and maybe ending the payments in 2023? Then they say I don’t “qualify” for hardship. Something must be done. Many State employees gave me wrong answers, etc. I have been told I will never be able to work. The insurance just keeps sending loads of paperwork. Someone help me please!!!
