Calif. Workers’ Comp Permanent Disability Ratings Not Bound by AMA Guides

    On April 6th the WCAB granted reconsideration of its own decisions in both cases. The Board has invited Guzman (which last month filed a writ of review with the Court of Appeal) and all interested non-parties to file briefs by May 1. Reply briefs are to be filed by May 21.

    The law is not yet settled at either the Board level or the Ct. of Appeal.

    Woo Hoo!. It’s about time we see a chance for WC rates to go through the roof again. I am tired of making only 30% of what I was making in 2005-2006. Let’s get this moving again so CA can be the highest in the nation again.

    This was a bad dicision overall. The point to the changes in 2004 was to stop the blantant strangle hold and fraud by Applicant attorney’s and their docs/chiros. Although these judges do not know this, but should, most MD’s are trained to think in ADL’s, activities of daily living, not in effects to work comp. This is a small portion of the overall picture in US medicine. It is appropriate from the stand point of a true medical professional. I have 9 years as a nurse case manager, and a former VP of a nurses union. I have seen it all. I had contact with the developers of SB 899. This is a pure shame.

    It has been proven that the disability is much higher when someone else is responsible. When the injured party is responsible and has no one to pass the buck to, disability disapears. Everyone is looking for a check. If they increase and try to go back to court, I recommend that employers form Subrosa funds and catch these workers living their true lives. Remember, fraud is now a felony, 5 years and $ 50,000.00. Now the carriers will have the incentive to use those legal changes to the laws too.

    Attention: Current Worker Comp System is suck. It destroys life and family of the honest injury workers and it also brings miserable life, homeless, and bankruptcy to the honest injury workers. May God bless the honest injury workers and workers with safety and health. Californian Workers don’t ever get injury and take care of your safety first or your life will be messed up by the current Worker Comp Systems.

    arnold you really screwed the workers in ca when you took office.
    i mean honest workers may the lord have mercy on you
