The Arizona Supreme Court has turned away a legal challenge to the state’s budget-balancing move to take $4.6 million paid into a special workers’ compensation insurance fund.
The Supreme Court declined to accept jurisdiction of a special-action lawsuit filed by a state commission that oversees workers’ compensation.
At issue is a January budget-balancing law’s grab of money paid by insurance companies and self-insured employers.
The Industrial Commission contended that the $4.6 million is private money that does not belong to the state.
