Anyone in action sports will be injured at one time or another. It’s part of the game. What surfer hasn’t been cut by his fin or hit in the head by his board? So what’s next, sue the state for coral cuts

Summary Judgement for the defense. This clown had ample time to inspect the board prior to buying it and before he took it into the water. He must be fairly experienced since he was in France when this happened. Judges shouldn’t allow the courts to get clogged with this kind on nonsense.

As surfer of 20+ years I have had my share of fin cuts, stitches, etc. from my surfboards. Not one of these came from a malfuncion of my board(s), but rather the waves not doing what I anticpated them to do. Can I sue the ocean or is it considered sovereign?

Wait. did he sign the idiot proof waiver prior to buying and taking possession of the actual board?

As a surfer for 20+ years, I’ve had my share of fin cuts, stiches, bruises, etc. Not ONE injury was caused my a malfunction on my board(s), rather the wave not doing what I thought it was going to do. In that logic – Can I sue the Ocean or is it sovereign?
